Mug shot of Pedro Anthony Rivera

Tuesday morning, a Chaparral man accused of shooting his father with a shotgun is set to go before a jury.

Pedro Anthony Rivera is charged with attempted first-degree murder and aggravated battery with a deadly weapon.

Prosecutors say he shot and seriously injured his father last September.

Police say Rivera opened fire after he and his dad got into an argument.

A Dona Ana County deputy found Rivera's dad walking down a road with a gunshot wound.

He was hospitalized in critical condition.

Jury selection started Monday and opening statements are expected to start Tuesday.

He'll be in a Las Cruces district courtroom starting at 8 a.m.
